Acceptance and availability of the general terms and conditions

These General Terms and Conditions govern all legal relationships arising from sales contracts entered into between users or customers and the owner of the website stendio.ie, eCommProjects Internet S.L..

By accepting these General Terms and Conditions, the customer declares that they have the legal capacity required to enter into contracts in accordance with the applicable legislation. In Ireland, the age of majority and full contractual capacity are generally acquired at the age of 18. If the customer acts on behalf of a legal entity, the individual acting declares, under their sole responsibility, that they have the necessary authority of representation.

The customer expressly accepts these General Terms and Conditions from the moment they use the website or purchase any product, and shall be bound by them. These General Terms and Conditions shall remain permanently available on the website and may be saved and printed by the customer.

The user expressly undertakes to make proper use of the website and not to use the services offered for, among others, the following purposes:

• Disseminating unlawful, violent or discriminatory content based on sex, origin, religion, beliefs, age or condition, or content that infringes fundamental rights protected by applicable Irish or European legislation.
• Disseminating content constituting unlawful or misleading advertising or content contrary to unfair competition or consumer protection regulations.
• Introducing computer viruses or carrying out actions capable of altering, interrupting or damaging the systems, data or electronic documents of eCommProjects Internet S.L. or third parties, or preventing other users from accessing the website.
• Infringing intellectual or industrial property rights protected under applicable legislation.
• Impersonating other users or third parties.

Reproducing, copying, distributing, making available to the public, publicly communicating, transforming or modifying the website contents without prior authorisation from the relevant rights holder or outside legally permitted cases is prohibited.

Applicable legal provisions

These General Terms and Conditions shall be governed by Spanish legislation.

However, where the user is considered a consumer and habitually resides in Ireland or another Member State of the European Union, they shall retain the protection granted by the mandatory provisions of the legislation of their country of habitual residence, in accordance with Regulation (EC) No. 593/2008 (Rome I).

In particular, the following regulations shall apply, where relevant:

• Royal Legislative Decree 1/2007 approving the General Law for the Protection of Consumers and Users.
• Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE).
• Regulation (EU) 2016/679 (GDPR).
• Irish consumer protection legislation, including the Consumer Rights Act 2022, the Sale of Goods and Supply of Services Act 1980 and the Competition and Consumer Protection Act 2014, insofar as applicable to consumers residing in Ireland.
• Irish and European legislation relating to data protection, electronic commerce, intellectual property and digital services.

Amendments to the general terms and conditions

eCommProjects Internet S.L. reserves the right to amend these General Terms and Conditions at any time in order to adapt them to legislative or case law developments or to improvements in the services and/or products offered on the website.

However, such amendments shall not affect contracts already concluded, which shall continue to be governed by the conditions in force at the time of their execution.

The new General Terms and Conditions shall only apply to contracts entered into after their publication on the website stendio.ie.

Publication of the updated General Terms and Conditions on the website shall not replace the legal obligations relating to pre-contractual information, which shall be fulfilled during the contracting process.

Description of products and services

The essential characteristics of the products and services offered through the website stendio.ie are described in each product listing.

In particular, as this is an online poster store, clear information will be provided regarding the characteristics, format, dimensions and conditions of use of the products.

Where specific conditions apply to a particular product or service, these shall be duly indicated in the relevant product listing or specific section and shall prevail over these General Terms and Conditions where applicable.

eCommProjects Internet S.L. takes the utmost care in the description and presentation of the products and services available on the website. However, in the event of typographical, formal or numerical errors, especially regarding prices, characteristics or product availability, such errors shall not be binding on eCommProjects Internet S.L., and the company reserves the right to correct them at any time.

In such cases, eCommProjects Internet S.L. shall inform the customer as soon as possible, offering them the option to confirm the order under the correct conditions or to cancel it free of charge, with a full refund of any amounts paid.

Electronic contracting procedure

To place an order with Stendio, the following steps must be completed:

• Select your product(s) on the website and click “Add to basket” to add them to your order.
• Open the shopping basket by clicking the basket icon (top right corner) and then click “Checkout” in the dropdown menu that appears.
• On the “Order Summary” screen, you will be able to review the selected products and click “Checkout” again if you wish to continue with the purchase.
• Finally, you will reach a screen where you must complete your shipping details, billing details, shipping method and payment method.
• Once the information has been completed on the “Checkout” screen, click “Complete purchase”.
• Depending on the selected payment method, you may need to complete payment through the payment gateway, or this step may not be necessary.
• Finally, you will be taken to a confirmation screen and a copy of the sales contract and order summary will be sent to you by email.

Please note that if payment is made by debit or credit card, the charge will be processed as soon as the payment process is completed.

Price

Each product category displays its retail price inclusive of taxes.

In certain cases, the exact price charged to the customer may include shipping costs, which are specified in the shipping section. Likewise, once a product has been added to the basket, the customer will be able to view all relevant shipping cost information. In the event of any discrepancy between the shipping costs indicated in the relevant section of the website and those shown when completing the order in the basket, the amount displayed at the final stage of the order shall always prevail.

Shipping

At Stendio, only products that can be delivered within a reasonable timeframe may be purchased. Product availability will be indicated in each product listing.

Shipping methods, delivery times and shipping costs shall be governed by the information provided in the relevant section of our website.

The company shall make every reasonable effort to ensure that shipping providers comply with the established delivery times. However, if such timeframes are not met for reasons beyond the control of eCommProjects Internet S.L., the company shall not be held responsible for delays and shipping costs shall therefore not be refundable.

An order shall be deemed delivered when the delivery note appears signed in the courier company’s systems.

We shall not be held responsible for any additional costs arising from customs duties or import charges.

Service and liability

eCommProjects Internet S.L. does not guarantee the continuous and uninterrupted availability of the website or the products and/or services offered. However, the company shall be liable in accordance with applicable Spanish legislation and, where relevant, the mandatory consumer protection provisions established under Irish and European legislation.

In this regard, eCommProjects Internet S.L. shall not be liable, to the extent legally permitted, for damages arising from service interruptions, errors or omissions in the contents, or the transmission of harmful software, except in cases of wilful misconduct, fraud, gross negligence or breach of essential obligations.

eCommProjects Internet S.L. shall not be liable for delays or failures resulting from force majeure events, including, among others, strikes, labour disputes, riots, terrorist acts, armed conflicts, pandemics, fires, extreme weather conditions or other unforeseeable or unavoidable circumstances.

eCommProjects Internet S.L. reserves the right to refuse the reproduction or printing of content which, in its opinion, may infringe applicable legislation, third-party rights or fundamental legal principles, including unlawful, discriminatory, violent content or content contrary to the protection of minors or public order.

The user declares that they are responsible for the documents or content provided for reproduction or printing and guarantees that they hold the necessary rights for their use, reproduction and, where applicable, distribution.

The user undertakes to indemnify and hold harmless eCommProjects Internet S.L. against any third-party claims arising from the infringement of intellectual property, industrial property or other rights.

eCommProjects Internet S.L. undertakes to treat the files or documents provided by the user confidentially and to use them exclusively for the execution of the order, in accordance with Regulation (EU) 2016/679 and the applicable Spanish and Irish data protection legislation.

The files shall only be retained for the time necessary for the proper execution of the service and, in any case, shall be deleted within a maximum period of 90 days from completion of the order, unless a legal retention obligation applies.

Right of exclusion

Stendio reserves the right to deny or restrict access to the website stendio.ie to users or customers who breach these General Terms and Conditions or the applicable legislation.

Such measures shall be adopted proportionately and taking into account the legitimate rights and interests of the user.

Invalidity and ineffectiveness of clauses

If any provision of these General Terms and Conditions is found to be wholly or partially invalid or unenforceable, this shall not affect the validity of the remaining provisions.

The invalid provision shall be replaced by the corresponding legal provision. In the event of a contractual gap, it shall be supplemented in accordance with the applicable legal provisions.

Applicable law, dispute resolution and jurisdiction

The contractual relationship between eCommProjects Internet S.L. and the user shall be governed by Spanish legislation.

However, where the user is considered a consumer and habitually resides in Ireland or another Member State of the European Union, they shall retain the protection granted by the mandatory provisions of the legislation of their country of habitual residence, in accordance with Regulation (EC) No. 593/2008 (Rome I).

In the event of a dispute, and where the user is considered a consumer, the courts of the consumer’s place of habitual residence shall have jurisdiction, in accordance with Regulation (EU) No. 1215/2012.

In all other cases, where the user is not considered a consumer, the parties submit to the courts corresponding to the registered office of eCommProjects Internet S.L., unless otherwise required by mandatory law.

eCommProjects Internet S.L. informs users that it is neither obliged nor willing to participate in alternative dispute resolution procedures before consumer mediation or arbitration bodies, unless legally required to do so.

Submission of complaints

Users may submit complaints to eCommProjects Internet S.L. through the contact methods indicated on the website.

Likewise, they may contact the competent consumer protection authorities in accordance with the legislation applicable in their place of residence.
